Terms of Service

These Terms govern your access to and use of the Binshare platform — the mobile apps, website at binshare.co.uk and related services operated by Binshare Ltd. Please read them carefully before using the service.

1. Introduction

Welcome to Binshare. These Terms of Service (the "Terms") form a legally binding agreement between you and Binshare Ltd, a company registered in England & Wales (Company No. 16909547) with its registered office at Caernarfon, Gwynedd, United Kingdom ("Binshare", "we", "us", "our").

By creating a Binshare account, downloading the Binshare mobile application, or otherwise using the Binshare platform (together, the "Service"), you confirm that you have read, understood and agree to be bound by these Terms and by our Privacy Policy and Acceptable Use Policy. If you do not agree, you must not use the Service.

2. Definitions

  • "Customer" means a homeowner, tenant, landlord, business or other end-user who posts a waste disposal request or rents bin/skip space through Binshare.
  • "Waste Carrier" (or "Carrier") means a person or business that holds a valid Upper- or Lower-Tier Waste Carrier Licence issued by the relevant UK environment regulator (Environment Agency, SEPA, NRW or NIEA) and registers with us to offer waste-collection services.
  • "Host" means a Customer who lists their own bin or skip space for short-term use by another Customer.
  • "Job" means a discrete waste-collection or bin-space-sharing transaction listed on Binshare.
  • "User Content" means any text, photos, reviews, postcodes or other information you submit to the Service.

3. Eligibility

To use Binshare you must:

  • be at least 18 years old;
  • reside in, or operate a business legally established in, the United Kingdom;
  • have the legal capacity to enter into a binding contract; and
  • not be prohibited from using the Service under any applicable law.

Binshare is currently offered only within Great Britain and Northern Ireland. We may add, restrict or remove geographies at our discretion.

4. Accounts

You are responsible for keeping your login credentials confidential and for all activity on your account. You agree to provide accurate, current and complete information when registering and to update it promptly when it changes.

Notify us immediately at support@binshare.co.uk if you suspect unauthorised access. We may suspend or close any account that appears to be compromised or used in breach of these Terms.

5. Our role as marketplace

Binshare is a digital marketplace. We connect Customers with independent Waste Carriers and with other Customers who have spare bin or skip space. We are not a party to any contract for waste collection, transport, treatment or disposal made between users. We are not a licensed waste carrier ourselves and we do not collect, transport or dispose of waste.

Although we verify each Waste Carrier's licence on registration and re-check periodically, Customers remain responsible for satisfying themselves that the Carrier they book is suitable for their job and is operating lawfully. Carriers are independent contractors and not employees or agents of Binshare.

6. Customer obligations

When you post a Job or use a Carrier you agree to:

  • accurately describe the waste — including type, volume and any hazardous content — and upload a clear photo where requested;
  • only present waste you are legally entitled to dispose of (you are the "waste producer" and retain duty of care under section 34 of the Environmental Protection Act 1990 until the waste is transferred to a licensed Carrier);
  • pay agreed fees promptly through the Service and not attempt to circumvent Binshare by paying the Carrier directly off-platform;
  • refrain from offering or transferring hazardous waste (including asbestos, clinical waste, fuels, oils, gas cylinders or chemicals) via standard Binshare listings — specialist licensed services must be used for such waste.

7. Waste carrier obligations

By registering as a Carrier you represent and warrant that:

  • you hold a current, valid Waste Carrier Licence from the Environment Agency (or equivalent UK regulator) and will keep it valid for the duration of your use of Binshare;
  • you maintain appropriate public liability and motor insurance for the waste-collection activities you carry out;
  • you will transfer all collected waste only to permitted waste-management facilities and will complete a Waste Transfer Note (or equivalent duty-of-care record) for every load;
  • you will respond to Customer messages and complete booked Jobs within the timeframes you have agreed; and
  • you will not solicit Customers off-platform during the 12 months following an introduction made through Binshare.

Binshare reserves the right to verify your credentials at any time and to suspend or remove your account if you cannot evidence a valid licence.

8. Bin & skip space sharing

Hosts may list spare capacity in their own household bins or hired skips for short-term use by neighbours. The following rules apply:

  • Bin-space sharing is intended for household waste only. Commercial waste must be handled by a licensed Carrier.
  • Hosts must comply with their local council's rules on bin use, weight limits and contamination, and with any terms of skip-hire agreements.
  • Hosts are responsible for inspecting waste deposited by other users and may refuse any item they reasonably believe is hazardous, oversized, or otherwise non-compliant.
  • Income earned by Hosts may be taxable. It is your responsibility to comply with HMRC reporting requirements (including the £1,000 Trading Allowance threshold where applicable).

9. Fees and payments

All payments for Jobs are processed in-app through our payment provider. Binshare charges a flat 5% service fee on each completed Job, which is disclosed clearly before you confirm a booking. There are no listing fees and no subscriptions.

Payouts are processed manually by the Binshare operations team after each completed Job, so that we can verify the work was done satisfactorily before funds are released. Carrier and Host payouts are paid to your linked UK bank account, typically within five (5) working days of Job completion.

All prices are quoted in pounds sterling (GBP) and include any applicable UK VAT unless otherwise stated. We may withhold payouts where we reasonably believe a Job is fraudulent, in dispute, or otherwise breaches these Terms.

10. Cancellations & refunds

A Customer may cancel a booked Job free of charge up to 24 hours before the agreed collection time. Cancellations made inside 24 hours may incur a charge equal to up to 50% of the agreed price, payable to the Carrier or Host.

If a Carrier fails to attend, attends without the means to complete the Job, or completes the Job to a materially inadequate standard, Binshare will mediate in good faith and may issue a full or partial refund at its discretion.

Your statutory rights under the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013 are not affected.

11. Reviews & content

You may leave reviews of Carriers, Hosts and Jobs you have used. Reviews must be honest, based on your own first-hand experience and must not be defamatory, discriminatory or otherwise unlawful. We may remove reviews that breach these Terms.

You retain ownership of any User Content you submit, but you grant Binshare a worldwide, royalty-free, non-exclusive licence to host, display, reproduce and distribute that content for the purpose of operating and promoting the Service.

12. Prohibited use

You must not:

  • use Binshare to facilitate fly-tipping or any other illegal disposal of waste;
  • impersonate another person or misrepresent your licence status;
  • upload viruses, attempt to gain unauthorised access to the Service or interfere with its operation;
  • scrape, harvest or reproduce listings or User Content for competing services without our prior written consent; or
  • use the Service to harass, discriminate against or harm others.

Suspected illegal waste activity will be reported to the relevant UK regulator and, where appropriate, the police.

13. Intellectual property

Binshare and our licensors own all rights, title and interest in and to the Service, including the Binshare name, logo, branding and all software. Except for the limited licence granted to you to use the Service, no rights are transferred to you. You must not copy, modify, reverse engineer or create derivative works from any part of the Service.

14. Liability

Nothing in these Terms excludes or limits our liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; or any other liability that cannot be excluded under applicable law.

Subject to the above and to the maximum extent permitted by law:

  • we provide the Service on an "as is" and "as available" basis and we do not warrant that it will be uninterrupted or error-free;
  • we are not liable for any acts or omissions of Carriers, Hosts or other users, and any contract for waste services is between those users directly;
  • our aggregate liability to you in any 12-month period arising out of or in connection with the Service is limited to the greater of (a) the total amount you paid us, or were paid by us, in that period; or (b) £100; and
  • we are not liable for indirect or consequential loss, loss of profits, loss of goodwill, or loss of data.

15. Indemnity

You agree to indemnify and hold Binshare, its officers, employees and agents harmless from any claim, loss, cost or expense (including reasonable legal fees) arising out of your breach of these Terms, your User Content, or your unlawful disposal of waste.

16. Suspension & termination

You may stop using the Service and close your account at any time via the in-app settings or by contacting us. We may suspend or terminate your access immediately if you breach these Terms, if we are required to do so by law, or if your use of the Service exposes us or other users to material risk.

On termination, all provisions of these Terms which by their nature should survive (including liability, indemnity, governing law and IP) will continue to apply.

17. Changes to these terms

We may update these Terms from time to time to reflect changes to the Service, the law or our business. The "Effective" date at the top of the page indicates when the current version took effect. We will notify you of material changes via the app or by email at least 14 days before they take effect. Continued use of the Service after that date constitutes acceptance of the updated Terms.

18. Governing law & disputes

These Terms and any non-contractual obligations arising out of them are governed by the laws of England & Wales. Subject to the paragraph below, the courts of England & Wales have exclusive jurisdiction.

Before issuing court proceedings you agree to contact us at support@binshare.co.uk and try to resolve the dispute informally. If you are a consumer resident in Scotland or Northern Ireland, you may bring proceedings in your local courts.
